MANGALORE, JULY 09: The Christian community leaders of the diocese of Mangalore met and discussed the pros and cons of implementing the Uniform Civil Code in India during a symposium held in the city on Sunday evening on July 09, 2023 at Shanthi Kiran Pastoral Centre, Bajjodi, Mangaluru.

ಮ0ಗಳೂರು, ಜೂಲಾಯ್ 09: ಏಕರೂಪ ನಾಗರಿಕ ಸಂಹಿತೆಯನ್ನು ಜಾರಿಗೊಳಿಸುವ ಬಗ್ಗೆ ಇರುವ ಸಾಧಕ-ಭಾದಕಗಳ ಬಗ್ಗೆ ಮಂಗಳೂರು ಧರ್ಮಕೇಂದ್ರದ ಕ್ರೈಸ್ತ ಮುಖಂಡರು ಸಭೆ ಸೇರಿ ಚರ್ಚಿಸಿದರು.
ಕರ್ನಾಟಕದ ಉಚ್ಚ ನ್ಯಾಯಾಲಯದ ನಿವೃತ್ತ ನ್ಯಾಯಾಧೀಶ ಜಾನ್ ಮೈಕಲ್ ಡಿಕುನ್ಹಾ ರವರು ಸವಿಸ್ತಾರವಾಗಿ ವಿಷಯವನ್ನು ಸಭೆಗೆ ಮಂಡಿಸಿದರು. ಹಿರಿಯ ಬರಹಗಾರ ಹಾಗೂ ಸೆವಕ್ ಪತ್ರಿಕೆಯ ಸಂಪಾದಕ ವಂದನೀಯ ಚೇತನ್ ಲೋಬೊ ಪ್ರತಿಕ್ರಿಯೆ ನೀಡಿದರು. ಸಭಾ ಪಾಲಕರಾದ ಖ್ಯಾತ ವಕೀಲ ಎಂ. ಪಿ. ನೊರೊನ್ಹಾರವರು ವಿವಿಧ ವಿಚಾರಗಳನ್ನು ಪ್ರಸ್ತಾವಿಸಿ ಸದಸ್ಯರ ಆಭಿಪ್ರಾಯಗಳನ್ನು ಸಕ್ರಿಯವಾಗಿ ಚರ್ಚಿಸಲು ಅವಕಾಶವನ್ನು ಮಾಡಿಕೊಟ್ಟರು ಮತ್ತು ಮುಕ್ತ ಚರ್ಚೆ ನಡೆಯಿತು. ಸದಸ್ಯರ ಎಲ್ಲಾ ಅಭಿಪ್ರಾಯಗಳನ್ನು ಕ್ರೋಢಿಕರಿಸಿ ಈ ಕೆಳಗಿನ ಐದು ಠರಾವುಗಳನ್ನು ನಿರ್ಣಯಿಸಲಾಯಿತು ಮತ್ತು ಕಾನೂನು ಆಯೋಗಕ್ಕೆ ಸದರಿ ವಿಚಾರಗಳ ಬಗ್ಗೆ ಮನವಿ ನೀಡಲು ನಿರ್ಧರಿಸಲಾಯಿತು.
1. ಭಾರತ ಸರಕಾರದ ಕಾನೂನು ಆಯೋಗವು ಪ್ರಕಟಿಸಿದ ಪ್ರಶ್ನಾವಳಿಯನ್ನು ಉತ್ತರಿಸಲು ಹಾಗೂ ಆಯೋಗವು ಬಯಸಿರುವಂತೆ ಯಾವುದೇ ಸಲಹೆಗಳನ್ನು ನೀಡಲು ಕ್ರೈಸ್ತ ಸಮುದಾಯಕ್ಕೆ ಸಾಧ್ಯವಾಗುತ್ತಿಲ್ಲ. ಕಾರಣ ಉದ್ದೇಶಿತ ಶಾಸನದ ಕರಡು ಪ್ರತಿ, ವಿಷಯಗಳು ಮತ್ತು ವಿವರಗಳನ್ನು ತಿಳಿಯಪಡಿಸಿಲ್ಲ. ಏಕರೂಪ ನಾಗರಿಕ ಸಂಹಿತೆಯ ಬಗ್ಗೆ ಯಾವುದೇ ಚರ್ಚೆಯನ್ನು ಪ್ರಾರಂಭಿಸುವ ಮೊದಲು ಕಾನೂನಿನ ಕರಡು ಪ್ರತಿಯನ್ನು ಎಲ್ಲಾ ಪಾಲುದಾರರಿಗೆ ಮತ್ತು ಸಾರ್ವಜನಿಕರಿಗೆ ಲಭ್ಯವಾಗುವಂತೆ ಕೋರಲಾಗಿದೆ.
2. ಮೇಲಿನ ಆಕ್ಷೇಪಣೆಗೆ ಚ್ಯುತಿಯಿಲ್ಲದೆ, 21 ನೇ ಕಾನೂನು ಆಯೋಗವು ಈಗಾಗಲೇ ಅಸ್ತಿತ್ವದಲ್ಲಿರುವ ಕುಟುಂಬ ಕಾನೂನುಗಳಿಗೆ ಸುಧಾರಣೆಗಳನ್ನು ಸೂಚಿಸುವ ವರದಿಯನ್ನು ಈಗಾಗಲೇ ಸಲ್ಲಿಸಿದೆ. ಆ ವರದಿಯಲ್ಲಿರುವ ಶಿಫಾರಸುಗಳನ್ನು ಸೂಕ್ತ ರೀತಿಯಲ್ಲಿ ಪ್ರಸ್ತುತ ಕಾನೂನು ಆಯೋಗವುಕಾರ್ಯಗತಗೊಳಿಸಬೇಕು ಎಂಬುದು ಮಂಗಳೂರು ಧರ್ಮಪ್ರಾಂತ್ಯದ ಸಮುದಾಯದ ಅಭಿಪ್ರಾಯ. ಹೀಗಿರುವಾಗ, ಏಕರೂಪ ನಾಗರಿಕ ಸಂಹಿತೆಯನ್ನು ಕೈಗೆತ್ತಿಕೊಳ್ಳಲು ಯಾವುದೇ ತುರ್ತು ಅಥವಾ ಅವಶ್ಯಕತೆ ಉಂಟಾಗಿಲ್ಲ.
3. ಪ್ರಸ್ತಾವಿತ ಏಕರೂಪ ನಾಗರಿಕ ಸಂಹಿತೆಯ ಸಾಂವಿಧಾನಿಕ ಪ್ರಾಮುಖ್ಯತೆ ಮತ್ತು ಧನಾತ್ಮಕ ಪರಿಣಾಮಗಳನ್ನು ಮಂಗಳೂರು ಧರ್ಮಪ್ರಾಂತ್ಯದ ಕ್ರಿಶ್ಚಿಯನ್ ಸಮುದಾಯವು ಪರಿಗಣಿಸಿ ಪ್ರಸ್ತಾವಿತ ಶಾಸನದ ಅನುಷ್ಠಾನಕ್ಕೆ ಪೂರ್ವಭಾವಿಯಾಗಿ ಕ್ರೈಸ್ತರು ಸೇರಿದಂತೆ ಎಲ್ಲಾ ಸಮುದಾಯಗಳ ಎಲ್ಲಾ ಪಾಲುದಾರರನ್ನು ಒಳಗೊಂಡಿರುವ ಪ್ರತಿನಿಧಿ ಸಮಿತಿಯನ್ನು ರಚಿಸುವ ಮೂಲಕ ವಿಸ್ತಾರ ಸ್ವರೂಪದ ಮಾತುಕತೆ ಆರಂಭಿಸಿ ಸಮಾಲೋಚನೆ ನಡೆಸಲು ಮಂಗಳೂರು ಧರ್ಮಪ್ರಾಂತದ ಕ್ರೈಸ್ತಸಮುದಾಯ ಆಗ್ರಹಿಸುತ್ತದೆ.
4. ವೈಯಕ್ತಿಕ ಕಾನೂನು ಭಾರತೀಯ ಕ್ರೈಸ್ತರು ಪಾಲಿಸುವ ಧರ್ಮದ ಭಾಗವಾಗಿದೆ. ಪ್ರಸ್ತಾವಿತ ಸಂಹಿತೆಯು ಕ್ರೈಸ್ತ ಧಾರ್ಮಿಕತೆಯಲ್ಲಿ ಮಾಡುವ ಅನಪೇಕ್ಷಿತ ಹಸ್ತಕ್ಷೇಪವಾಗಿದೆ ಎಂಬುದು ಸಮುದಾಯದ ದೃಢ ಅಭಿಪ್ರಾಯ. ಭಾರತದ ಸಂವಿಧಾನದ ವಿಧಿ 25 ರ ಅಡಿಯಲ್ಲಿ ಖಾತರಿಪಡಿಸಲಾದ ಹಕ್ಕುಗಳು ವಿಧಿ 29 ಮತ್ತು 30 ರ ಅಡಿಯಲ್ಲಿ ನೀಡಲಾದ ಅಲ್ಪಸಂಖ್ಯಾತರ ಹಕ್ಕುಗಳು. ಕ್ರೈಸ್ತರ ವೈಯಕ್ತಿಕ ಕಾನೂನುಗಳು ಸಮುದಾಯದ ಧರ್ಮ, ಪದ್ಧತಿಗಳು ಮತ್ತು ರೀತಿ-ನೀತಿಗಳ ಮೇಲೆ ನಿಂತಿವೆ ಹಾಗೂ ಸಂವಿಧಾನದದಿAದ ಸಂರಕ್ಷಿತವಾಗಿವೆ
5. ಇನ್ಯಾವುದೇ ವೈಯಕ್ತಿಕ ಕಾನೂನನ್ನು ಕ್ರೈಸ್ತ ಅಲ್ಪಸಂಖ್ಯಾತರ ಮೇಲೆ ವಿಸ್ತರಿಸುವ ಇರಾದೆಯ ವಿರುದ್ಧ ಕ್ರೈಸ್ತ ಸಮುದಾಯವು ಬಲವಾದ ಆಕ್ಷೇಪಣೆಯನ್ನು ದಾಖಲಿಸುತ್ತದೆ. ಅಂಥಹ ಯಾವುದೇ ಪ್ರಯತ್ನ ಭಾರತೀಯ ಕ್ರೈಸ್ತರ ಸಾಮಾಜಿಕ, ಧಾರ್ಮಿಕ ಮತ್ತು ಸಾಂಸ್ಕೃತಿಕ ಗುರುತು ಮತ್ತು ಅನನ್ಯತೆಯನ್ನು ನಾಶಪಡಿಸುತ್ತದೆ
ಸಭೆಯಲ್ಲಿ ಮಂಗಳೂರು ಬಿಷಪ್ ಆತೀ ವಂದನೀಯ ಡಾ| ಪೀಟರ್ ಪಾವ್ಲ್ ಸಲ್ಡಾನ್ಹಾ, ಶ್ರೆಷ್ಠಗುರು ಆತೀ ವಂದನೀಯ ಮ್ಯಾಕ್ಸಿಮ್ ನೊರೊನ್ಹಾ, ಚಾನ್ಸೆಲರ್ ವಂದನೀಯ ಡಾ. ವಿಕ್ಟರ್ ಜೋರ್ಜ್ ಡಿಸೋಜಾ, ಮಾಜಿ ಶಾಸಕರಾದ ಜೆ. ಆರ್ ಲೋಬೋ, ಮಾಜಿ ವಿಧಾನ ಪರಿಷತ್ ಸದಸ್ಯರಾದ ಐವನ್ ಡಿಸೋಜಾ, ಮಹಾನಗರ ಪಾಲಿಕೆಯ ಪ್ರತಿಪಕ್ಷ ನಾಯಕ ನವೀನ್ ಡಿಸೋಜ, ಕರ್ನಾಟಕ ಸಿಆರ್‌ಐ ಅಧ್ಯಕ್ಷರಾದ ಭೆಥನಿ ಧರ್ಮಭಗಿನಿ ಸಿಸಿಲಿಯಾ ಮೆಂಡೊನ್ಸಾ, ಸಂಪರ್ಕಾಧಿಕಾರಿ ವಂದನೀಯ ಜೆ ಬಿ ಸಲ್ಡಾನ್ಹಾ ಹಾಗೂ ರೋಯ್ ಕ್ಯಾಸ್ತೆಲಿನೊ, ಕಥೊಲಿಕ್ ಸಭಾ ಅಧ್ಯಕ್ಷರಾದ ಆಲ್ವಿನ್ ಡಿಸೋಜಾ, ಹಲಾವಾರು ಧರ್ಮಗುರುಗಳು, ಧರ್ಮಭಗಿನಿಯರು, ವಕೀಲರು, ವೈದ್ಯರು, ಸಾಮಾಜಿಕ ಮುಖಂಡರು ಮತ್ತು ಶ್ರೀಸಾಮಾನ್ಯರು ಹಾಜರಿದ್ದರು.
ಧರ್ಮ ಪ್ರಾಂತ್ಯದ ಶ್ರೀಸಾಮಾನ್ಯ ಆಯೋಗದ ಕಾರ್ಯದರ್ಶಿ ವಂದನೀಯ ಜೆ. ಬಿ. ಕ್ರಾಸ್ತಾ ಸ್ವಾಗತಿಸಿ, ಕುಟುಂಬ ಆಯೋಗದ ಕಾರ್ಯದರ್ಶಿ ವಂದನೀಯ ಅನಿಲ್ ಡಿಸೋಜಾ ಧನ್ಯವಾದ ಸಮರ್ಪಿಸಿದರು. ಧರ್ಮ ಪ್ರಾಂತ್ಯದ ಪಾಲನಾ ಪರಿಷದ್ ಕಾರ್ಯದರ್ಶಿ ಡಾ| ಜೋನ್ ಎಡ್ವರ್ಡ್ ಡಿಸಿಲ್ವಾ ಕಾರ್ಯಕ್ರಮವನ್ನು ನಿರೂಪಿಸಿದರು. ಪತ್ರಿಕಾ ಪ್ರತಿನಿಧಿ ಕೆನರಾ ಕಮ್ಯುನಿಕೇಷನ್ ಸೆಂಟರ್ ನಿರ್ದೇಶಕ ಅನಿಲ್ ಫೆರ್ನಾಂಡಿಸ್ ಹಾಗೂ ಶ್ರೀ ಎಲ್ಯಾಸ್ ಫೆರ್ನಾಂಡಿಸ್ ಹಾಜರಿದ್ದರು.

The study session was jointly organised by the Family Commission and Lay Faithful Commission of the diocese of Mangalore.
Mr John Michael DCunha, the retired Judge of Karnataka High Court spoke on the topic and elaborated its nuances. He said, “The idea of a Uniform Civil Code comes from Article 44 (one of the Directive Principles of State Policy) of the Constitution. It is the duty of the state to implement the UCC throughout India keeping in mind the best interest of the country and its citizens.”
Mr Michael opined that UCC should not be randomly implemented and applied as it will cause prejudice to the integrity and unified diversity of the country amounting to breach of fundamental rights.
Rev. Chetan Lobo, veteran journalist and the editor of Sevak magazine responded. Moderated of the session advocate Mr M. P. Noronha proposed various perspectives of UCC and opened the house for discussion. Participants presented their views. Consolidating all the views of the members, the following five issues were considered and it was decided to present the issues to the Law Commission.
- The Christian Community is at a loss to answer the questionnaire published by the Law Commission and is handicapped to offer any suggestions as called for by the Commission without knowing the contents and the substance of the proposed legislation. Therefore, it is requested, that before initiating any discussion on the subject, copy of the draft Uniform Civil Code be made available to all stake holders and the general public.
- Without prejudice to the above objection, it is submitted that the 21st Law Commission having already submitted a report suggesting reforms to the existing family laws, the Christian Community of the Mangalore Diocese is of the view that due effect be given to the recommendations by the present Law Commission, as no urgency or necessity has arisen to undertake the formulation of UCC.
- The Christian Community of the Mangalore Diocese submits that having regard to the Constitutional importance of the proposed UCC and the consequences that would arise in the implementation of the proposed legislation, the Parliament requested to initiate a wider consultation by constituting a representative Committee consisting of all the stake holders including the members of the Christian Community.
- Personal law is part of the religion professed by the Indian Christians. The Christian Community is of the firm opinion that the proposed UCC is an interference with the religious rights guaranteed under Article 25 and the minority rights conferred under article 29 and 30 of the Constitution of India. The personal laws of the Christians are based on the religion, customs and usages which are protected under the Constitution.
- Personal law is part of the religion professed by the Indian Christians. The Christian Community is of the firm opinion that the proposed UCC is an interference with the religious rights guaranteed under Article 25 and the minority rights conferred under article 29 and 30 of the Constitution of India. The personal laws of the Christians are based on the religion, customs and usages which are protected under the Constitution.
- The Christian Community places on record its strong objection in extending any other personal law of other communities to the Indian Christians, as it would destroy the social, religious and cultural identity and uniqueness of the Indian Christians.

B Saldanha and Mr Roy Castelino, Catholic Sabha President Mr Alwyn D’Souza, priests, nuns, lawyers, doctors, social workers, community leaders and lay faithful were present.
Rev. Fr J B Crasta, Secretary, Lay Faithful Commission and Director St Antony Ashram Jeppu welcomed the gathering. Rev.
